01Acceptance of Terms

By accessing and using MyDesk ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use this Platform. Digital Response Pty Ltd ("we", "us", "our") reserves the right to modify these terms at any time.

02Use License

Permission is granted to temporarily use MyDesk for business and operational purposes. This is the grant of a limited, non-exclusive, non-transferable license, not a transfer of title. You retain all ownership rights to data you input into the Platform.

You may not:

Copy, modify, or reverse engineer the Platform software
Transfer your license to another person or entity
Attempt to access or use the Platform for unauthorized purposes
Circumvent any security measures or access controls
Use the Platform to develop competing products or services

03Referral Program Terms

Our Referral Program allows existing MyDesk customers ("Referrers") to earn rewards by referring new businesses to the Platform ("Referrals").

Program Eligibility

Referrers must be current paid MyDesk subscribers
Referrals must be businesses not currently using MyDesk
Referrals must complete their free trial and upgrade to a paid plan to qualify
Multiple referrals from the same Referrer are unlimited

Reward Terms

10% discount on monthly subscription applies per qualifying referral
$50 gift voucher awarded per qualifying referral
Discounts are cumulative and compound with each successful referral
Maximum annual discount cap of $500 per Referrer (applies to discount benefits only)
Gift vouchers do not expire and can be combined for single purchases
Milestone rewards are granted upon reaching 5, 10, 15, and 20+ referrals

Terms and Conditions

Rewards are credited 7 business days after Referral completes trial upgrade
Referral code is unique and non-transferable to other accounts
Referrers cannot create false referrals or abuse the program for rewards
We reserve the right to audit referrals and revoke rewards if fraud is detected
Referral rewards cannot be combined with other promotional offers unless explicitly stated
Program may be modified or terminated with 30 days written notice

04Subscription and Billing

Paid MyDesk subscriptions are billed monthly or annually based on your selected plan. Your subscription will automatically renew at the end of each billing period unless you cancel via your account settings.

Payment Terms:

Payment is due at the start of each billing period
We accept major credit cards and bank transfers
Failed payments may result in service suspension
Refunds are issued according to our refund policy
All prices are in AUD unless otherwise stated

05Intellectual Property Rights

All content, features, and functionality of MyDesk (including but not limited to software, source code, and user interface) are owned by Digital Response or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws. Your use of the Platform does not grant you any ownership rights to any intellectual property.

06Data Security and Privacy

Digital Response is committed to protecting your data and complying with applicable privacy laws including the Privacy Act 1988 (Cth). Your personal information is handled according to our Privacy Policy. By using MyDesk, you consent to our collection and use of information as described in the Privacy Policy.

Your responsibilities:

Maintain strict confidentiality of your login credentials
Notify us immediately of any unauthorized access to your account
Ensure compliance with data protection regulations in your jurisdiction
Regularly back up your important data

07Disclaimer of Warranties

MyDesk is provided "as is" and "as available". Digital Response makes no warranties, expressed or implied, and hereby disclaims all other warranties, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that defects will be corrected.

08Limitation of Liability

In no event shall Digital Response be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of MyDesk, even if notified of the possibility of such damages.

Our total liability to you for all claims arising from these Terms shall not exceed the total amount paid by you to Digital Response in the 12 months preceding the claim.

09Acceptable Use Policy

You agree not to use MyDesk for any purpose that is unlawful or prohibited by these Terms. Prohibited behavior includes:

Harassment, abuse, or threatening conduct toward other users
Transmission of viruses, malware, or malicious code
Spam, phishing, or fraudulent activities
Unauthorized access to other users' accounts or data
Violation of any applicable laws or regulations

10Termination

Digital Response may terminate or suspend your account and access to MyDesk at any time, without notice or liability, for conduct that violates these Terms or is otherwise harmful to us or other users. Upon termination, your right to use the Platform will immediately cease.

11Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts of Queensland.
